Good news: PoolVerify does not sell, rent, or trade your personal information to third parties for monetary or other valuable consideration.

This page exists to comply with the California Consumer Privacy Act (CCPA) requirement that businesses provide a clear and conspicuous link titled "Do Not Sell My Personal Information" for California residents to exercise their opt-out rights.

Under the California Consumer Privacy Act (CCPA), California residents have the right to opt-out of the "sale" of their personal information. This page explains what that means, our practices, and how you can exercise your privacy rights.

1. What Constitutes a "Sale" Under CCPA?

Under CCPA, a "sale" is broadly defined as sharing, renting, releasing, disclosing, or otherwise communicating personal information to another business or third party for monetary or other valuable consideration.

1.1 What We DON'T Do

  • We do not sell your personal information to data brokers
  • We do not rent your contact information to marketing companies
  • We do not share your inspection data with competitors
  • We do not trade your information for advertising revenue
  • We do not monetize your data in any way

1.2 Service Providers We Work With

We do share limited personal information with trusted service providers who help us operate PoolVerify. These are NOT considered "sales" under CCPA because:

  • They are contractually prohibited from using your data for any purpose other than providing services to us
  • They cannot sell or share your information with others
  • They must maintain appropriate security measures
  • They have Data Processing Agreements in place that comply with California privacy law

Our service providers include:

  • Clerk: Authentication and user account management
  • Supabase: Secure database and file storage
  • Polar.sh: Payment processing (Merchant of Record)
  • Resend: Transactional email delivery for inspection reports
  • Vercel: Application hosting and infrastructure

2. Analytics and Advertising

2.1 Website Analytics

We may use analytics services (such as Google Analytics) to understand how visitors use our website and improve the user experience. These analytics services may collect:

  • Pages you visit and time spent on each page
  • Your general location (city/state level)
  • Device and browser information
  • How you found our website (referral source)

Your Control Over Analytics

When you first visit PoolVerify, you'll see a cookie consent banner. You can choose to accept or decline analytics cookies. If you decline, we will not load any analytics tracking scripts. You can change your preferences at any time through the cookie settings.

2.2 Advertising and Marketing

We may use advertising platforms (such as Google Ads or Facebook Ads) to:

  • Show ads to people who might benefit from pool inspection software
  • Track whether ads led to website visits or signups (conversion tracking)
  • Exclude current customers from seeing ads (audience suppression)

Under some interpretations of CCPA, sharing data with advertising platforms could be considered a "sale." Even though we don't receive money directly, the advertising service provides value (ad targeting) in exchange for data.

How to Opt-Out of Marketing Tracking

You control whether marketing scripts can run on your browser. When you visit PoolVerify:

  • Choose "Necessary Only" on the cookie banner to block all marketing tracking
  • Select "Customize" to enable analytics but disable marketing cookies
  • Change your preferences anytime via the cookie icon in the bottom-right corner

3. How to Exercise Your Opt-Out Right

California residents can opt-out of any potential "sale" of personal information through the following methods:

Control analytics and marketing tracking by adjusting your cookie preferences. This prevents third-party tracking scripts from loading on your browser.

Submit a formal opt-out request through your Privacy Dashboard. This ensures your preferences are saved to your account and honored across all devices.

3.1 For Non-Account Holders

If you don't have a PoolVerify account but want to opt-out of any tracking:

  1. Click "Necessary Only" on the cookie consent banner when you visit our website
  2. Your browser will save this preference, and we will not load any analytics or marketing scripts
  3. To opt-out on additional devices, repeat this process on each device/browser

3.2 For Account Holders

If you have a PoolVerify account, you can exercise your opt-out right through the Privacy Dashboard:

  1. Go to Settings → Privacy & Data
  2. Click the "Right to Opt-Out" card
  3. Submit your opt-out request
  4. We will process your request and confirm via email within 15 business days

✓ Your Opt-Out Will Be Honored

Once you opt-out, we will not share your personal information with third-party analytics or advertising platforms. Your opt-out preference will remain in effect unless you choose to opt back in.

5. Response Timeline

When you submit an opt-out request or exercise any privacy right:

  • Acknowledgment: We will acknowledge your request within 10 business days
  • Verification: We may ask you to verify your identity to protect your privacy
  • Response: We will respond to your request within 45 calendar days (may extend to 90 days for complex requests)
  • Confirmation: You will receive email confirmation once your request is processed
  • No Charge: We will not charge you a fee to process your request

Verification Required

To protect your privacy, we may ask you to verify your identity before processing requests. This typically involves confirming your email address or answering security questions. We will only use the information you provide for verification purposes.

6. Authorized Agents

You may designate an authorized agent to submit privacy requests on your behalf. To do so, the authorized agent must:

  • Provide proof of authorization (such as a power of attorney or signed permission)
  • Verify their own identity
  • We may also require you to directly confirm the agent's authorization
